1. Service Description

Forgemoji (the "Service") is operated by the Forgemoji team. We provide AI-powered Emoji image generation using third-party AI APIs. All generated images are machine-produced outputs — not hand-crafted artwork or database lookups.

2. Eligibility

By using the Service, you confirm that you are at least 13 years old (16 in certain jurisdictions, including the EU/EEA), have the legal capacity to accept these Terms, and can be held responsible for your use of the Service. Minors must have parental or guardian consent.

3. Ownership of Generated Content

You own the images you generate. We assign to you all rights, title, and interest in the AI outputs produced from your inputs (emoji selections), to the extent permitted by applicable law. You may freely download, share, and use them for personal or commercial purposes.

Please note:

  • Copyright ownership of AI-generated content remains legally unsettled in many jurisdictions. You are solely responsible for evaluating applicable law before commercial use.
  • If generated output resembles existing third-party works, you bear sole responsibility for any resulting legal claims.
  • You may not use generated content to infringe third-party rights, spread misinformation, or engage in any unlawful activity.

4. AI-Generated Content Disclosure

All images produced by this Service are created by machine learning models and are not photographs or human-made art. We display clear labeling within the UI. When sharing generated images publicly, we recommend adding an "AI Generated" note to maintain transparency with your audience.

5. Usage Limits

To prevent abuse, the Service enforces rate limits of 3 requests per IP per minute and 20 requests per IP per day. For higher-volume access, please contact us.

You may not attempt to circumvent these limits or use automated tools to bulk-generate images.

6. Prohibited User Content

Forgemoji is a generative AI tool. You are responsible for the emoji inputs you submit and the outputs you choose to download, share, or publish. The following categories of content are strictly prohibited and may not be generated, downloaded, or distributed through the Service:

  • Child sexual abuse material (CSAM) — any depiction of a minor in a sexual context. We report all suspected CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement without notice.
  • Non-consensual intimate imagery — nudity, sexual content, or intimate depictions of identifiable real people without their consent.
  • Hate speech and targeted harassment — content that dehumanizes, degrades, or incites violence against a person or group on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
  • Incitement to real-world violence or self-harm — content that encourages, depicts, or celebrates imminent physical harm against a specific individual or group, or suicide and self-injury instructions.
  • Specific copyrighted brand characters — recognizable trademarked characters (e.g., Pikachu, Mickey Mouse, Mario, Peppa Pig, Hello Kitty) and other works that are obviously third-party intellectual property. Generic concepts (a fire-breathing dragon, a cute cat) are fine; specific branded characters are not.
  • Impersonation of real identifiable persons — mashups that closely resemble a living public figure in a misleading or defamatory context.
  • Misinformation designed to deceive — deepfake-style imagery created or distributed to mislead about real events, public statements, or identity.

The list above is non-exhaustive. We may prohibit additional categories as the underlying AI providers, network partners, and applicable laws evolve.

7. Content Moderation & Enforcement

We use a combination of automated filtering, downstream AI provider safety classifiers, and human review to enforce Section 6. Our moderation process works as follows:

  • Pre-send filter: every emoji-pair request is screened against a blocklist of high-risk combinations (sexually suggestive, extremist, branded) before it reaches the image model.
  • Output classifier: the generated image is scanned by the underlying AI provider's safety classifier (e.g., NSFW and violence filters) before it is returned to your browser.
  • Rate and anomaly limits: abusive or automated traffic is throttled or blocked at the edge (see Section 5).
  • User reports: anyone can flag a specific generated image or emoji combination by emailing hello@forgemoji.com with the prompt and a screenshot. We review reports within 2 business days.

Enforcement actions. Depending on severity, we may: (a) remove or block the offending combination; (b) warn the responsible IP; (c) throttle or revoke access; or (d) report the activity to the relevant authority (NCMEC for CSAM, law enforcement for credible threats, the rights-holder for repeated IP infringement). Repeat offenders are permanently blocked at the network level. We do not disclose enforcement actions publicly, but we retain anonymized logs for audit purposes.

Because the Service does not require an account and does not store user identities, our ability to take action is necessarily limited to network-level blocks and the removal of specific emoji combinations from the public-facing picker.

8. Copyright Complaints (DMCA / Takedown)

If you believe that content generated by this Service infringes your copyright, please send a written notice to hello@forgemoji.com with the subject line "DMCA Notice". Your notice must include:

  • Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved).
  • Identification of the allegedly infringing material, with enough detail (the emoji combination used and a URL or screenshot) for us to locate it.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights-holder or authorized to act on the rights-holder's behalf.
  • Your physical or electronic signature.

We will acknowledge receipt within 3 business days, review the claim, and either remove or disable access to the disputed material, or explain why we believe the complaint is invalid. If you are a counter-notifying user, you may submit a counter-notice to the same address; we will follow the procedure required by 17 U.S.C. § 512(g).

Our designated DMCA agent is the Forgemoji team, reachable at hello@forgemoji.com. We do not currently maintain a separate designated agent address.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that generated content will be accurate, unique, or free from similarity to existing works.

AI models are probabilistic systems; outputs may vary and may not meet your expectations. You use generated content at your own risk.

10. Uploaded Photos & Privacy

We do not store any photos you upload. In Custom Photo mode (Layer 3), your photo is read locally on your device, converted to a base64 string, and sent to a Serverless function that processes it and discards it immediately. Image data is never written to any database, object storage, or log file.

Your photo is forwarded to a third-party AI model (such as MiniMax, Stability AI, or Replicate) as a reference input for inference, subject to that provider's privacy policy. We recommend you do not upload images containing sensitive personal information.

11. Third-Party AI Services

The Service relies on third-party AI APIs to provide its core generation capabilities. We may use the following types of providers (without limitation) at any given time:

  • Image generation models: APIs from providers such as MiniMax, Stability AI, Replicate, Together AI, or similar platforms.
  • Large language models: APIs from providers such as OpenAI, Anthropic, Google Gemini, or similar platforms, used to assist in prompt construction.

Your request data (emoji identifiers and generated prompt text) is transmitted to the applicable provider's servers and governed by that provider's own terms of service and privacy policy. We will keep this section updated to reflect our current integrations, but we are not responsible for any third-party provider's availability, security, or data practices.

We do not rely exclusively on any single provider and reserve the right to switch or combine providers based on quality, cost, compliance, or other factors.

12. Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a revised date. Continued use of the Service constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws applicable to your use of the Service. If you are an EU/EEA resident, nothing in these Terms limits your statutory rights under applicable consumer protection or data protection law (including GDPR).
